These Terms of Sale govern purchases made through eloumi.com (the “Store”). The Store is operated by BEAX LLC, doing business as ELOUMI (“ELOUMI”, “we”, “us”), 102 Gold Avenue SW, Ste 603, Albuquerque, NM 87102, United States. Email: contact@eloumi.com.

By placing an order, you agree to these Terms of Sale. Please read them together with our Shipping & Delivery Policy, Returns & Refunds Policy, Limited Warranty and Privacy Policy, which form part of these Terms.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to place an order. Our products are made for children, but the Store is intended for adults purchasing for them.

2. Personal use

Products are sold for personal, household use. We may refuse or cancel orders that appear to be placed for unauthorized resale, commercial redistribution or any fraudulent or unlawful purpose.

3. Product information

We make reasonable efforts to describe and photograph our products accurately, including dimensions, materials and features. Screens may display colors slightly differently, measurements are approximate, and props shown in photos (books, bottles, plush toys) are not included unless stated. The product page states what is included in your purchase.

Our children’s products are designed for the age range shown on the product page. Please follow the care and safety information supplied with the product.

4. Availability

Products shown as “in stock” are held in inventory in the United States and are available for immediate purchase. Stock levels can change quickly. If an item becomes unavailable after you order, we will notify you promptly and give you a full refund for that item.

5. Prices and taxes

All prices are in U.S. dollars. The price that applies to your order is the price shown at checkout. Shipping charges, if any, are shown before you pay. Applicable sales taxes, if any, are calculated and displayed at checkout.

We may change prices at any time, but changes will not affect orders already accepted, except in the case of an obvious pricing error as described below.

6. Payment

Accepted payment methods are shown at checkout. Card and digital-wallet payments (major credit and debit cards, Apple Pay, Google Pay, Link and, where eligible, pay-later options provided by third parties under their own terms) are processed securely by Stripe, Inc. and charged when you place your order. ELOUMI does not receive or store your full card number.

Bank transfer: you may also pay by ACH or domestic wire transfer to our U.S. business bank account. Our bank details are shown after you place your order and in your confirmation email. Please include your order number as the payment reference. Your order is reserved for 5 business days; it is processed once the funds have arrived in our account, and it may be canceled if payment has not been received within 5 business days. Any fees charged by your bank for sending the transfer are your responsibility.

By submitting payment, you confirm that you are authorized to use the payment method or bank account.

7. Order acceptance

After you place an order, you will receive an email confirming that we received it. This confirmation does not yet mean the order is accepted. Your order is accepted when we ship it and send a shipping confirmation.

We may refuse or cancel an order where reasonably necessary, for example in case of an obvious pricing or product error, suspected fraud or unauthorized payment, an undeliverable address, or unavailability. If we cancel an order after payment, we will refund the full amount paid for the canceled items.

8. Changes and cancellations by you

You may cancel or change an order free of charge until it has shipped. Please email contact@eloumi.com with your order number as soon as possible. Once an order has shipped, it can no longer be canceled, but you may return it under our Returns & Refunds Policy.

9. Shipping and delivery

We ship from inventory located in the United States to addresses in the 50 U.S. states and Washington, D.C. Orders are generally processed within 1–2 business days (for bank transfers, after your payment has arrived), and standard transit takes 2–5 business days. Delivery estimates are not guaranteed. If we cannot ship your order within the time we stated, or within 30 days if no time was stated, we will notify you, give you a revised shipping date and let you choose between accepting the delay or canceling for a prompt, full refund.

Risk of loss passes to you when the carrier delivers the package to the shipping address you provided.

10. Returns and refunds

You may return eligible products within 30 days of delivery as described in our Returns & Refunds Policy. Return shipping for a change of mind or an exchange is paid by the customer. Returns related to a defect, damage in transit or an error on our part are free.

11. Limited warranty

Our products are covered by a one-year limited warranty against defects in materials and workmanship, described in our Limited Warranty. Nothing in these Terms limits any implied warranty or consumer right that cannot lawfully be limited.

12. Pricing and typographical errors

If a product is listed at an obviously incorrect price or with incorrect information due to an error, we may cancel any order for that product and refund the amount paid, even after an order confirmation has been sent.

13. Intellectual property

The ELOUMI name and logo, product designs, photographs, text and other content of the Store are owned by or licensed to BEAX LLC and protected by intellectual-property laws. You may not copy, reproduce or use them commercially without our prior written permission.

14. Limitation of liability

To the fullest extent permitted by law, BEAX LLC will not be liable for indirect, incidental, special, consequential or punitive damages arising from a purchase or from use of the Store. Our total liability relating to a product or order will not exceed the amount you paid for that product.

These limitations do not apply to liability that cannot be excluded or limited by law, including liability for personal injury caused by our negligence, fraud or willful misconduct, and they do not affect your rights under the Limited Warranty.

15. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, natural disasters, carrier disruptions, labor disputes, government action or power or communication failures. This does not remove your right to cancel and receive a refund for an order that has not shipped.

16. Informal dispute resolution

If you have a concern, please contact us first at contact@eloumi.com with your name, order number, a description of the issue and the resolution you are looking for. We will try in good faith to resolve it within 30 days. This does not prevent either party from seeking urgent relief or exercising a right that cannot legally be delayed.

17. Governing law and courts

These Terms and all purchases are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. Subject to any non-waivable right you may have to bring a claim in your home state, the state and federal courts located in Bernalillo County, New Mexico have jurisdiction over disputes arising from these Terms or a purchase. These Terms do not require private arbitration and do not contain a class-action waiver.

18. Electronic communications

By placing an order, you agree to receive transactional emails such as order confirmations, shipping notices and refund confirmations. These are not marketing messages. Marketing emails are only sent if you subscribe, and you can unsubscribe at any time.

19. Changes to these Terms

We may update these Terms from time to time. The version in effect when you place your order applies to that order. The “Last updated” date shows the latest revision.

20. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. These Terms, the policies they reference, the product page and your order confirmation form the entire agreement for your purchase.
